1. About These Terms

These Terms of Service ("Terms") govern your use of the Pick Me a Fit website and services at pickmeafit.com ("the Service"), operated by James Moss, trading as Pick Me a Fit ("we", "us", "our"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. The Service

Pick Me a Fit is an AI-powered styling service that helps you discover and purchase outfits. Our Service includes:

• AI styling recommendations based on your preferences, sizes and budget
• Virtual try-on using photos you upload
• Product sourcing from third-party retailers (including eBay)
• Subscription-based access to styling features

We act as a styling and sourcing service. When you purchase items through links we provide, you are buying directly from third-party sellers. We are not the seller of the clothing items themselves.

Some product links may be affiliate links. If you click one of those links or buy through it, we may earn a commission from the retailer or affiliate network at no extra cost to you.

3. Accounts

To use certain features, you must create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 16 years old to create an account.

4. Subscriptions and Billing

Pick Me a Fit offers a monthly Pro subscription at the price displayed in Stripe Checkout. By subscribing, you agree to the following:

• Each verified account receives 10 complete outfit generations free every calendar month. The allowance refreshes automatically at the start of the next month. A free outfit is used only after a complete sourced outfit passes its checks, is shown on you, and is saved successfully
• Eligible first-time Pro subscribers receive a 14-day free trial. A payment method is required. Unless you cancel before the trial ends, Stripe automatically charges£4.99 and the subscription then renews monthly at £4.99/month until cancelled. Applicable taxes, if any, are shown at checkout
• The introductory trial is limited to one per customer or account. Previous subscribers are charged£4.99 when they resubscribe, as shown at checkout
• Active Pro includes unlimited complete outfit generations and virtual try-ons for normal human use. Automated or abusive use remains subject to technical rate limits and these Acceptable Use terms
• You may cancel at any time through your account settings. Cancelling before an introductory trial ends avoids the first subscription charge. Otherwise, cancellation takes effect at the end of your current billing period
• Existing annual subscriptions or introductory trials created before this offer changed remain governed by the price, renewal date and trial terms shown when they were purchased
• Legacy top-up balances already attached to an account remain recorded for support reconciliation. New top-up sales are not part of the current offer
• Failed or incomplete sourcing, failed virtual try-ons, and results that do not pass the complete-outfit checks do not use a virtual try-on credit
• We reserve the right to change pricing with 30 days' notice
• Refunds are handled on a case-by-case basis

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Upload content that is offensive, harmful, or infringes on others' rights
• Attempt to reverse-engineer, scrape, or interfere with the Service
• Share your account credentials with others
• Use automated tools to access the Service without our permission

6. Intellectual Property

All content, branding, and technology comprising the Service belong to Pick Me a Fit or our licensors. You retain ownership of any photos you upload, but grant us a licence to use them solely to provide the Service (e.g. generating virtual try-on images).

7. AI-Generated Content

Our styling recommendations and virtual try-on images are generated by AI. While we strive for accuracy, AI outputs may not always be perfect. Colours, fits and product availability may vary from what is shown. We do not guarantee that AI recommendations will suit your personal preferences.

Virtual try-on images are illustrative. Garment drop, length, colour, material appearance and body fit are estimates based on the information, photos and listing details available to us. You should check the seller's measurements, size labels, condition notes and photos before buying.

8. Third-Party Services

The Service integrates with third-party services including eBay, Stripe and Supabase. Your use of those services is governed by their respective terms. We are not responsible for the availability, accuracy or policies of third-party services.

Product listings, prices, sizes, measurements, availability and seller descriptions are supplied by third-party sellers or marketplaces. You should review the seller's listing before buying.

We do not authenticate third-party products or guarantee seller descriptions, product condition, measurements, delivery, returns or availability. If authenticity, exact fit, delivery time or returns matter to you, check the seller's listing, photos, feedback and policies before purchase.

9. Limitation of Liability

To the maximum extent permitted by law, Pick Me a Fit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Termination

We may suspend or terminate your account if you breach these Terms. You may delete your account at any time from your profile or by contacting us. Account deletion cancels an active subscription immediately. Upon termination, your right to use the Service ceases immediately, though we may retain certain data as described in our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last updated" date. Continued use of the Service after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
